DiveDiveGo Terms of Service

Please read these Terms of Service carefully before using the DiveDiveGo platform.
1. Definitions
- Account: A unique account created for You to access our Service.
- Diver: A user who books diving experiences through the platform.
- Partner: A dive shop or independent operator offering diving services on the platform.
- Company: DiveDiveGo, operating as the Service provider and platform administrator.
- Service: The DiveDiveGo platform, including the website and mobile applications.
- Terms: These Terms of Service.
- You: The user accessing or using the Service, whether as an individual or on behalf of a legal entity.

3. Acknowledgment
These Terms govern the relationship between You and DiveDiveGo. By using the Service, You agree to comply with these Terms. If You do not agree with any part of these Terms, You must not access or use the Service.
DiveDiveGo accounts and bookings must be made by individuals aged 18 or older. However, certain diving experiences may be suitable for minors under the supervision of a parent or legal guardian. It is the responsibility of the parent or guardian to ensure that all requirements (including age, certification, and safety) are met.
Use of the Service is also subject to our Privacy Policy, which outlines how we handle Your personal data.
4. Use of the Platform
4.1 DiveDiveGo is an online marketplace facilitating bookings between Divers and independent Partners.
4.2 The Company is not a direct provider of diving services and assumes no responsibility for the quality, safety, legality, or conduct of Partners.
4.3 You agree not to circumvent the platform to make bookings directly with Partners outside of DiveDiveGo.
5. Booking and Payments
5.1 All bookings must be made through the DiveDiveGo platform.
5.1.1 Some bookings require Partner approval. In such cases, your booking is treated as a request until the Partner approves it.
5.1.2 When you submit a booking request, your payment method may be authorized at that time but is only captured after the Partner approves the booking.
5.1.3 If the Partner does not approve the booking, the payment authorization will be voided or expire in accordance with your bank or payment provider’s rules.
5.2 Payments are processed securely through third-party providers (Stripe, PayPal). DiveDiveGo does not store full payment information.
5.3 DiveDiveGo adds a service fee (averaging 10%) on top of the Partner’s listed price.
6. Cancellation and Refunds
6.1 Each diving experience listing on DiveDiveGo includes a clearly defined cancellation policy selected by the Partner. This policy is displayed on the listing page prior to booking and governs your ability to cancel or receive a refund.
6.2 A booking may be cancelled either by the Diver or by the Partner through the DiveDiveGo platform, subject to the applicable cancellation policy displayed in the listing.
6.3 Once a booking has been approved by the Partner and payment has been captured, cancellations by the Diver can only be made in accordance with the cancellation policy shown at the time of booking.
6.4 If cancellation is permitted, you must submit your request through the DiveDiveGo booking page by clicking “Request cancellation.” The time of request is tracked from the moment your request is submitted via the platform.
6.5 Cancellations submitted via email, phone, or third-party platforms are not valid.
6.6 If a booking is cancelled by the Partner for any reason, the Diver will receive a full refund of all amounts paid for the booking.
6.7 Refunds, when applicable, are processed by DiveDiveGo back to your original payment method within 5–10 business days, in accordance with the applicable cancellation policy.
6.8 DiveDiveGo acts as a marketplace and payment facilitator. Refunds are processed in accordance with the cancellation policy defined by the Partner for the relevant booking.
6.9 In the event of a dispute regarding a cancellation or refund, DiveDiveGo may review the circumstances and make a final determination for the purposes of refund processing on the platform.
6.10 DiveDiveGo may override a listing’s refund policy in exceptional cases, such as service failures, safety concerns, or fraud investigations, and issue full or partial refunds at its sole discretion.
6.11 No refunds are available once an experience has started or for missed appointments unless stated in the listing.
6.12 The platform does not support rescheduling of bookings. If you wish to reschedule, you must first cancel your booking in accordance with the applicable cancellation policy and then create a new booking.
6.13 You are responsible for cancelling any booking before its refund deadline. Failure to appear at the designated time and meeting point without prior cancellation may result in forfeiture of the entire booking amount.
6.14 Depending on the cancellation policy and payment method used, certain payment processing fees charged by third-party payment providers may be non-refundable and may be deducted from the refunded amount.
7. Diver Responsibilities
7.1 You confirm that You meet all safety and certification requirements outlined by the Partner.
7.2 You agree to follow all instructions provided before, during, and after the diving experience.
7.3 You are responsible for ensuring Your own fitness to dive and for obtaining any necessary medical clearance.
8. Communication and Support
8.1 All communication between Divers and Partners must be conducted through the DiveDiveGo messaging system.
8.2 Exchanging personal contact information or attempting to transact outside the platform is prohibited.
8.3 DiveDiveGo provides support for platform-related issues but is not responsible for resolving disputes between Divers and Partners, except as expressly stated in these Terms.
9. Liability and Assumption of Risk
9.1 You understand and acknowledge that diving is an inherently risky activity. You voluntarily assume all risks associated with participation.
9.2 DiveDiveGo disclaims all liability for incidents, injuries, or disputes arising from diving experiences.
9.3 You agree to hold DiveDiveGo harmless and indemnify the Company against any claims arising from Your participation in diving activities.
10. Termination
10.1 DiveDiveGo may suspend or terminate Your Account for violations of these Terms or misuse of the platform.
10.2 You may close Your Account at any time by contacting us or using the account deletion function.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which DiveDiveGo is registered, without regard to conflict of law principles.
11.1 For EU Users. You are entitled to any mandatory protections under the law of your residence.
11.2 For US Users. You confirm you are not on any US government list of prohibited or restricted parties.
12. Limitation of Liability
To the fullest extent permitted by law:
- DiveDiveGo is not liable for indirect, incidental, or consequential damages.
- DiveDiveGo’s total liability is limited to the amount You paid through the platform for the specific booking in dispute.
13. Dispute Resolution
You agree to contact DiveDiveGo first to attempt informal resolution of any dispute. DiveDiveGo may mediate disputes relating to refunds or cancellations but is not obligated to resolve disputes unrelated to platform transactions.
14. Changes to Terms
DiveDiveGo may update these Terms periodically. Material changes will be communicated via the platform. Continued use of the Service after changes constitutes acceptance.
15. Acceptance
By creating an account and booking through DiveDiveGo, You acknowledge that You have read, understood, and agreed to these Terms of Service.
